Metro Filming & Photography GuidelinesThe Los Angeles County Metropolitan Transportation Authority (Metro) provides bus and rail service throughout Los Angeles County. Since Metro is an integral part of Los Angeles County image and history its facilities, vehicles and equipment are often featured in movies, television programs, commercials, print ads and documentaries. Metro can provide production companies with site locations, vehicles, equipment and parking for use in their productions. Site locations (land structures and parking) exist throughout Los Angeles County. (Based on availability) Vehicles: • Metro Rail • Metro Bus Location and Settings• Subway and rail stations and platforms • Other Metro facilities: § Headquarters building § Board Room § Parking Garages § Operational Control Rooms § Etc. • Supervisory staff to assist with your filming needs • Other personnel as needed 1. Submit a Filming/Photography Request Form at least two weeks in advance of your filming date. 2. For questions or more information contact: 3. Attend a pre-production meeting held at the proposed filming location with you and a Metro representatives to discuss your plans and how we can accommodate them in compliance with Metro’s regulations and safety requirements. 4. Requests made less than two weeks in advance are subject to postponement. The use of Metro property by Licensee’s Production Crew is conditioned upon receipt by Metro of the following documents from Licensee at least 72 hours prior to production. i.) Minimum scope of insurance: Coverage shall be at least as broad as: 1. Insurance Services Office Commercial General Liability coverage (occurrence form CG0001 or equivalent) 2. Insurance Services Office form number CA0001 (or equivalent) covering Automobile Liability, code 1 (any auto). 3. Workers’ Compensation insurance as required by the State of California and Employer’s Liability Insurance. ii.) Minimum limits of insurance Licensee shall maintain limits no less than: 1. General Liability: $1,000,000 per occurrence for bodily injury, personal injury and property damage. If Commercial General Liability Insurance or other form with a general aggregate limit is used, the general aggregate limit shall be twice the required occurrence limit or $2,000,000. Products/Completed Operations aggregate shall apply separately to this contract/agreement or the aggregate limit shall be twice the required per occurrence limit. 2. Automobile Liability: $1,000,000 per accident for bodily injury and property damage. 3. Workers’ Compensation to comply with California’s statutory requirements. iii.) Other insurance provisions: The insurance policies required per the terms of the contract are to contain, or be endorsed to contain, the following provisions: 1. Metro, its subsidiaries, officials and employees are to be covered as additional insureds as respects liability arising out of the activities performed by or on behalf of the Contractor; products and completed operations of the Licensee; premises owned, occupied or used by the Licensee; or automobiles owned leased, hired or borrowed by the Licensee. The general liability coverage shall also include contractual, personal injury, independent contractors and broad form property damage liability. The coverage shall contain no special limitations on the scope of protection afforded to Metro, its subsidiaries, officials and employees. 2. For any claims related to this project, the Licensee’s insurance coverage shall be primary insurance as respects Metro, its subsidiaries, officials and employees. Any insurance or self-insurance maintained by Metro shall be excess of the Licensee’s insurance and shall not contribute with it. 3. Any failure to comply with reporting or other provisions of the policies including breaches of warranties shall not affect coverage provided to Metro, its subsidiaries, officials and employees. 4. The Licensee’s insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer’s liability. 5. Each insurance policy required by this clause shall be endorsed to state that coverage shall not be suspended, voided, canceled by either party, reduced in coverage or in limits except after thirty (30) days prior written notice has been given to Metro. 6. Workers’ Compensation and Employer’s Liability policies shall provide a waiver of subrogation in favor of Metro. iv.) Deductibles and self-insured retentions: Any deductibles or self-insured retentions must be declared to, and amounts over $25,000 approved by Metro. v.) Acceptability of insurers: Insurance is to be placed with California admitted insurers with a current A.M. Best’s rating of no less than A- VII, unless otherwise approved by Metro. vi.) Verification of coverage: Licensee shall furnish Metro with original endorsements and certificates of insurance evidencing coverage required by this clause. All documents are to be signed by a person authorized by that insurer to bind coverage on its behalf. All documents are to be received and approved by Metro before work commences. If requested by Metro, the Licensee shall submit copies of all required insurance policies, including endorsements affecting the coverage required by these specifications. vii.) Subcontractors: Licensee shall include all subcontractors as insured under its policies or shall furnish separate certificates and endorsement for each subcontractor. All coverage for subcontractors shall be subject to all of the requirements stated herein. If requested by Metro, the Licensee shall submit copies of all required insurance policies, including endorsements affecting the coverage required by these specifications. i. The ROE pertains to public-use facilities only, such as train platforms and terminals, not bus garages or maintenances facilities. Metro’s ROE minimum fee is $1,000 per day, per location (except parking lots). 6. Other Personnel A check payable to the Los Angeles County Metropolitan Authority shall be submitted before the start of production. Federal identification number is 95-4401975 Cancellation must be in writing and received by Metro prior to 11:00 a.m. the day before the production’s scheduled start date. In the event production is scheduled to begin on a Sunday, notice of cancellation must be received by 11:00 a.m. the Friday prior to the production start date. If cancellation is not received by Metro the production must pay Metro for any labor expenses incurred as a result of untimely cancellation.
